DMCA / Copyright Policy
Effective date: [10/10/2026
BannerVanta respects copyright and expects users to submit only material they own or are authorized to use. We may remove or disable hosted banners and links alleged to infringe copyright. We cannot remove material from an external website we do not control.
Copyright agent
- Send notices and counter-notices to:
- Agent name or title: BrentDaug
- Email: sales-at-bannervanta-dot-app
Operator publication requirement: complete and publish these details, and determine and complete any applicable U.S. Copyright Office designation/renewal. Posting this policy does not itself register an agent or establish safe-harbor protection.
Infringement notice
A notice should contain:
- Your physical or electronic signature as the copyright owner or authorized representative.
- Identification of the copyrighted work, or a representative list if multiple works are involved.
- Identification of the material to remove or disable and information sufficient to locate it, including the exact Bannervanta URL or banner identifier and relevant destination URLs.
- Your mailing address, telephone number and email address.
- A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent or the law.
- A statement that the information is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner of the exclusive right allegedly infringed.
- Consider applicable exceptions, including fair use, before submitting a notice. Knowingly materially misrepresenting infringement or mistaken removal may carry legal consequences. We may request missing information and notify the affected user. A trademark or ordinary abuse complaint should use our Abuse Policy rather than a copyright notice.
Counter-notification
If you believe removal or disabling occurred because of mistake or misidentification, send the agent:
- Your physical or electronic signature.
- Identification of the removed or disabled material and its previous location.
- A statement under penalty of perjury that you have a good-faith belief removal or disabling resulted from mistake or misidentification.
- Your name, address and telephone number; a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located, or, if outside the United States, any judicial district in which the service provider may be found; and a statement that you will accept service of process from the original notifier or that person's agent.
- A counter-notice may be forwarded to the original notifier, including its contact information. Where the statutory counter-notice process applies, material may be restored not less than 10 and not more than 14 business days after receipt of a valid counter-notice unless the agent receives notice that the claimant has filed an action seeking a court order restraining the alleged infringement. Restoration is also subject to independent lawful reasons for restricting the material.
Repeat infringement
We maintain a policy of terminating, in appropriate circumstances, accounts of repeat infringers. We may also restrict an account for a serious infringement or other independent policy violation. We accommodate and do not interfere with applicable standard technical measures as defined by law. We do not determine copyright ownership conclusively merely by processing a notice.
Notices concerning links and third-party destinations
Identify whether the alleged infringement concerns artwork stored by BannerVanta, a public listing, an advertising destination link or material hosted elsewhere. We can remove or disable an affected BannerVanta item where appropriate. A BannerVanta notice is not a notice to the operator hosting the underlying external material, and we cannot guarantee that external copies disappear.
Provide precise locations rather than a general assertion that an entire account or website is unlawful. Where a notice concerns multiple items, distinguish the copyrighted works and affected links sufficiently for review. We may contact you to resolve ambiguity. Do not include unnecessary sensitive documents or unredacted identity information with a routine notice.
Good-faith removal and independent restrictions
We may remove or disable disputed material while processing a compliant notice and may inform the user of the complaint. We may retain records needed to document the notice, response and action, subject to the Privacy Policy and applicable law. Processing does not establish a judicial finding that the material infringes.
A counter-notice is a legal statement, not merely a request to undo moderation. Seek advice if you are unsure about ownership, authorization, jurisdiction or the statements you must make. A copyright counter-notice does not resolve an independent malware, adult-consent, fraud or other acceptable-use restriction. We may explain such an independent restriction where appropriate.
Misuse of the process
Do not submit a copyright notice to suppress criticism you do not own, resolve a billing disagreement or remove lawful competing advertising. Do not fabricate an authorization or signature. The statutory process does not eliminate defenses, exceptions or remedies available to either party. We may refer an ordinary complaint to the appropriate abuse or support channel rather than represent it as a DMCA notice.
